DMCA Policy

Parker Sutherland Accident respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged infringement that are reported to our designated Copyright Agent, identified below.

If you are a copyright owner or an agent thereof, and you believe that any content hosted on Parker Sutherland Accident infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing (please consult your legal counsel or see 17 U.S.C. § 512(c)(3) to confirm these requirements):

Filing a DMCA Notice of Infringement

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of where the material that you claim is infringing is located on the Parker Sutherland Accident website, with enough detail that we may find it.
  3. Contact Information: Your address, telephone number, and email address.
  4. Statement of good faith: A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy & penalty of perjury: A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Signature: Your physical or electronic signature.

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our Copyright Agent containing the following information (please consult your legal counsel or see 17 U.S.C. § 512(g)(3) to confirm these requirements):

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Parker Sutherland Accident may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
  • Your physical or electronic signature.
